This website and its contents are owned by Rosenvale Pty Ltd (ABN 61 080 135 753), trading as Rosenvale Vineyards. ‘Rosenvale’ in any of the stated variations, ‘us’, ‘our’ or ‘we’ refer to the owner of this website. The term ‘you’ or ‘your’ refers to the viewer or user of this website.
The use of this website is governed by these terms and conditions, which may be varied by Rosenvale Vineyards from time to time.
You may only use this website if you are aged 18 years or over or otherwise over the legal drinking age in your country or residence. You must immediately exit the website if you do not meet these requirements.
Every time you choose to access, view or interact with this website, you acknowledge to us that you are bound by these terms and conditions.
Purchases made through this site are made under Liquor License No 51209005.
Intellectual property and restrictions on use of content
Unless expressly stated otherwise, all intellectual property rights appearing on this website, such as names, trademarks (registered and unregistered), logos and copyright material, are owned by us and/or our related companies. You must not use that intellectual property in any way whatsoever, except as expressly permitted by us in writing (or in the case of copyright material, as permitted by Australian and international copyright laws).

Transactions on our website
The following terms and conditions apply to any orders and purchases you make from this website.
The prices advertised by Rosenvale Vineyards may be altered at any time without notice.
Prices quoted are in Australian dollars, include GST and all other taxes. Freight may be additional, but will be notified to you at the time of check-out.
The price payable for the goods is the price applicable on the date when we confirm your order.
You must not order or purchase goods from us if you are under 18 years of age. It is a condition of purchase that when you enter and confirm your order, you are certifying that you are 18 years of age or over.
You must not order or purchase goods from us for re-sale purposes. All goods must be purchased for personal use.
You must not order or purchase goods from us which are outside any order limits or restrictions which we may apply to our wines on this site.
When placing an order with Rosenvale Vineyards, you confirm that all the details that you have provided in completing the order are true and correct.
All orders are subject to acceptance by Rosenvale Vineyards. We may accept any order, in whole or in part, or decline any order. We are not liable to you in respect of those goods that we are unable to supply to you, provided that we refund any amounts paid by you in respect of the unsupplied goods.
Orders cannot be cancelled once accepted, unless by arrangement with us.
Wine vintages are subject to change without notice. If we are unable to supply you with wine of the vintage that you ordered, we will endeavour to advise you by email or telephone before despatch of your order. You will have the option to confirm, cancel or modify your order at this time. If, after several attempts, we are unable to contact you for whatever reason, we reserve the right to substitute it for the same wine of a different vintage.
Delivery is only to Australian addresses and can include PO boxes. For international wine orders, please contact us on +61 8 8562 3533.
If a freight cost applies, it will be provided at check-out.
Title and risk in the goods passes to you upon delivery of the goods to the delivery address.
Please allow 7 business days for your order to be despatched, from receipt of your order and payment.
Delivery timeframes will depend on your location and the freight service available to us in your area. Typically, orders to metropolitan addresses will take approx 3-5 business days, whilst orders to regional areas will take approx 5-12 business days. Please note that any delivery timeframes specified by us are indicative only.
Rosenvale Vineyards is not responsible for and does not accept liability for delay or non-delivery of products. In the case of late delivery, you must accept goods delivered.
If you are not at the delivery address at the time of delivery, the goods may be left with a person at the delivery address who is 18 years or older but may be required to show proof of age. In the event nobody is at the delivery address who meets the criteria under these terms and conditions, a waiting card will be left in your mailbox. This card will advise the next steps required to obtain delivery of your order. Your order will not be left with persons under the age of 18 years. Rosenvale Vineyards cannot agree to unattended deliveries in any circumstances.
Your chosen payment method will be charged for the goods and associated costs at the time of placing your order (prior to despatch).
If for any reason your chosen payment method is unable to be charged for the goods and associated costs, then Rosenvale Vineyards’ staff may contact you to advise that the order was unable to be processed.
Payment is only deemed to have been made once it has been received by us.
Your rights under the Australian Consumer Law are not affected by these terms and conditions, namely our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Rosenvale Vineyards will accept and replace faulty and/or out of condition goods or goods that are wrongly described or breach a consumer guarantee returned by you provided that the goods were not broken or damaged after delivery, the goods are not out of shelf life and you notify Rosenvale Vineyards of your intention to return the goods within 7 days of delivery. Returns cannot be accepted on the basis of not liking the wine. If your purchase incurred a delivery fee, then we will cover the cost of delivery for the return (only when Rosenvale Vineyards is at fault or have breached a consumer guarantee. In all other circumstances, the delivery charge will be deducted from the refund to you or at your expense).
Subject to any relevant statutory provisions, these terms contain the entire agreement between Rosenvale Vineyards and you on the subject matter and all representations, warranties and agreements (whether express or implied and whether statutory or otherwise) are expressly excluded and Rosenvale Vineyards’ liability is limited to the lessor of the cost of replacing the products, or the costs of obtaining equivalent products.

Responsible Service of Alcohol
Rosenvale Vineyards supports the responsible service and consumption of alcohol and recommends that alcohol be enjoyed in moderation.
It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. You therefore warrant that you are 18 years or over of age; and that any person that you are obtaining the products for is also 18 years or over.
